Can you go to jail for deepfakes? ›

The punishment for posting a deepfake varies by jurisdiction and the nature of the deepfake. It can range from monetary fines to imprisonment, especially in cases of revenge p*rn or when it threatens national security. Hollywood actresses and other victims of deepfake can also take civil legal action for damages.

To achieve this, deepfake detection solutions typically use a combination of deep learning algorithms, image, video, and audio analysis tools, forensic analysis, and blockchain technology or digital watermarking—all of which help the solution to identify inconsistencies undetectable to the human eye.

Facial and body movement

For images and video files, deepfakes can still often be identified by closely examining participants' facial expressions and body movements.

There is currently no federal law against disseminating such content. However, some legal professionals believe “such illicit practices may not require new legislation, as they already fall under a patchwork of existing privacy, defamation or intellectual property laws,” according to an article by Law.com.

As these generative artificial intelligence (AI) technologies become more common, researchers are now tracking their proliferation through a database of political deepfakes.

It's believed the biometric data is used to produce deepfake videos of victims. Combined with stolen credentials, these deepfakes let hackers bypass facial recognition protections on financial apps.

The tell-tale signs of a deepfake

A common example of this is with eyelashes peeking through a person's hair. Look for realism: Do the colours, shadows and backgrounds match? Look for things that might be impossible or bizarre, like weird hands, a foot merged with a tree, or even too many arms.

NPR identified three deepfake audio detection providers — Pindrop Security, AI or Not and AI Voice Detector. Most claim their tools are over 90% accurate at differentiating between real audio and AI-generated audio. Pindrop only works with businesses, while the others are available for individuals to use.

Defamation: Defamation involves the publication of false statements that harm a person's reputation. In the context of AI-generated content, defamation claims could arise when false statements accompany the AI-generated nude images.

It depends on the type of violation. Attempting to make content intended to slander an individual is illegal regardless of if it is from an AI or not. Another major one which many states have already banned before the new wave of AI image systems is “nonconsensual p*rnography”.

The Copyright Act provides copyright protection for works, including films, music, and creative content. Individuals infringing upon copyrights by creating deepfakes using copyrighted works without permission can face legal action under this act.

The Disrupt Explicit Forged Images and Non-Consensual Edits, or DEFIANCE Act, allows victims to sue if those who created the deepfakes knew, or “recklessly disregarded” that the victim did not consent to its making.

Not only has this technology created confusion, skepticism, and the spread of misinformation, deepfakes also pose a threat to privacy and security. With the ability to convincingly impersonate anyone, cybercriminals can orchestrate phishing scams or identity theft operations with alarming precision.

Gone are the days of stolen credit cards and hacked passwords; these cyber villains are harnessing the power of artificial intelligence to clone you. By leveraging artificial intelligence, deepfakes enable fraudsters to clone your face, voice, and mannerisms to steal your identity.

Researchers are developing new ways to detect deepfakes, such as AI models that spot color abnormalities. And authentication methods, like digital watermarks, can help prove that a video or image has been altered. But simply detecting deepfakes may not be enough to prevent harm.
